RIGHT OF WITHDRAWAL

A change of mind is part of the Traveller’s nature, yet every trade in the Thicket follows its own ancient binding laws. While some physical artefacts can find their way back to their den, digital enchantments, custom-tailored creations, and short-notice workshop bookings are bound by permanent magic and cannot be undone. Read this scroll carefully to see which paths can be untangled and where the borders of the law are set.

 

PART I: STATUTORY RIGHT OF WITHDRAWAL FOR PHYSICAL GOODS

(1) Information Concerning the Exercise of the Right of Withdrawal:

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

To exercise your right of withdrawal, you have to inform:

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form, but it is not obligatory. Returning the goods without comment does not constitute a legally effective withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

(2) Effects of Withdrawal:

If you withdraw from this contract, MyyaTales shall initiate the reimbursement of all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by the Company), without undue delay and in any event not later than fourteen days from the day on which the Company is informed about your decision to withdraw from this contract.

However, MyyaTales is entitled to withhold and delay this reimbursement until the goods have been successfully received back by the Company or until you have supplied definitive evidence of having sent back the goods, whichever is the earliest.

The Company will initiate such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. You shall send back the goods or hand them over to MyyaTales without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods.

(3) Exclusion of the Right of Withdrawal:

The right of withdrawal does not exist for contracts regarding goods made to customer specifications or clearly tailored to personal needs (personalised or custom-made products).

 

PART II: PREMATURE EXPIRATION OF THE RIGHT OF WITHDRAWAL FOR DIGITAL PRODUCTS

For contracts regarding the supply of digital content which is not supplied on a tangible medium (e.g. e-books, digital instructions, downloads), the statutory right of withdrawal expires prematurely if MyyaTales has commenced performance of the contract.

During the ordering process, you are requested to give your explicit consent to the commencement of the performance of the contract before the expiry of the withdrawal period and to confirm your knowledge that you lose your right of withdrawal upon commencement of the performance of the contract. Without this consent, an order for digital products is technically not possible. Digital products are non-refundable after the performance of the contract has commenced.

 

PART III: SERVICES RELATED TO LEISURE ACTIVITIES (WORKSHOPS)

In accordance with Section 18 Paragraph 1 No. 10 FAGG, there is no statutory right of withdrawal for services rendered in connection with leisure activities if a specific date or period is contractually provided for. Therefore, no statutory right of withdrawal exists for the booking of workshops.
