CHAPTER I: SCOPE OF APPLICATION
(1) These Terms and Conditions (T&Cs) apply in the version valid on the day of the conclusion of the contract to all purchase contracts for all products and services between Mystical Yarnling Tales e.U. (hereinafter referred to as "MyyaTales", "Company", or "we/us") and its contractual partners ("Customer", "Participant", or "you/your").
(2) By registering for a workshop or placing an order, the Customer agrees to these T&Cs and is bound by them, as well as the terms and conditions of the respective payment providers when using these. Should individual provisions of these T&Cs be wholly or partially invalid due to mandatory statutory provisions, the remaining provisions of these T&Cs shall remain valid and unaffected (Severability Clause).
CHAPTER II: REGISTRATION, ORDERS & CONCLUSION OF CONTRACT
(1) Digital Goods: For the order of digital products in online sales, the Customer submits a binding offer by clicking on the clearly labeled order button ("Exchange your Copper - Buy now") in the online shop. The contract is concluded upon acceptance of the offer by the Company by means of the order confirmation.
(2) Physical Goods: For physical products in online sales, the same conditions regarding orders & conclusion of contract apply as for digital products. In direct sales (on-site sales), the contract is concluded directly on-site upon payment and handover of the goods.
(3) MyyaTales Workshops: Registration for MyyaTales workshops must be submitted in writing via email, the contact form, or by placing an order on the website (www.myyatales.com), providing the first and last name, address, and email address. Available workshop spots are allocated in the order in which registrations are received. The regular registration deadline ends 14 (fourteen) days before the start of the workshop. After this deadline, short-notice bookings for remaining spots can only be made by ordering through the website.
(4) A binding contractual agreement is formed upon the sending of the registration confirmation, which obligates the registering person to pay the participation fee. The workshop spot is securely reserved once payment is received.
(5) Persons aged 14 and older are eligible to register for a workshop. If they are still minors, the written consent of a legal guardian is required. Individual workshops may require specific participation prerequisites regarding qualifications and age groups, which are detailed in the respective workshop description. By submitting a registration, participants declare that they meet these participation prerequisites.
(6) Registration for a workshop is not possible as long as there are outstanding payments due to MyyaTales. Furthermore, the company reserves the right to reject registrations based on past payment defaults, the grounds for exclusion defined below, or a lack of mutual trust.
CHAPTER III: DISCLAIMERS & PRICES
(1) All offers in the online shop and at MyyaTales events are non-binding and only become legally binding upon completion of the sales contract. In principle, the purchase price agreed upon for the ordered goods is the one displayed in the pricing information of the respective sales platform.
(2) All price indications are subject to printing, typesetting, and typographical errors.
(3) MyyaTales qualifies for the small business exemption pursuant to Section 6 Paragraph 1 No. 27 of the Austrian Value Added Tax Act (UStG). Therefore, no value added tax (VAT) is charged, and all stated prices are gross-equals-net prices, plus delivery costs.
CHAPTER IV: PAYMENT TERMS
(1) In online sales, the following payment methods are available to the Customer:
- Credit Card / Debit Card (Visa, Mastercard, American Express, Maestro, UnionPay)
- PayPal
- Klarna (Sofort/Pay Now)
- eps-Überweisung (for customers from Austria)
- Mobile Payment / Express Checkout (Apple Pay, Google Pay, Shop Pay)
(2) The purchase price is due for payment immediately upon conclusion of the contract. The debiting of the Customer's account or credit card takes place automatically as part of this process. The dispatch of the goods takes place immediately after confirmation of successful receipt of payment by the respective payment service provider. Invoices will be transmitted via email.
(3) In direct sales, payment can only be made in cash upon handover of the goods.
(4) In the event of culpable payment default by the Customer, the Company is entitled to charge a flat-rate reminder fee of EUR 5.00 for the second and each subsequent reminder to cover the resulting administrative effort, provided these costs are reasonably proportionate to the claim being pursued. Further statutory rights (e.g., to default interest) remain reserved.
CHAPTER V: DELIVERY AND SERVICE CONDITIONS
(1) Digital Products: The provision of digital content takes place after confirmed receipt of payment. Depending on the selected sales platform, not all offers may be available in all countries.
(2) Physical Products: The dispatch of physical products is currently only possible within the European Union (EU). More precise details regarding delivery times and shipping costs can be found in the respective country-specific table on the sales platform.
(3) Personalised Products & Duty to Cooperate: The Customer has a duty to cooperate in the case of personalised products and custom-made items (e.g. provision of data or approvals). Necessary feedback from the Customer must be provided within 7 days of the Company's request. If this period expires without success, and after another reasonable grace period has been set, Myyatales has the right to cancel the contract.
(4) Feedback Loops: The Customer is entitled to a single, free-of-charge feedback loop within the scope of personalisation. This corresponds to the bundling of all requested changes in a single, collective message. Any further feedback loop or subsequent change is subject to a fee and will only take place after separate agreement and for an additional charge.
(5) Workshops: Workshops take place at the dates and locations specified in the online shop. Attendance is only permitted after full payment of the workshop fee. Furthermore, the announced workshop instructor may be replaced by another instructor of equal qualification and capability without giving reasons.
CHAPTER VI: RETENTION OF TITLE
All delivered goods remain the property of MyyaTales until the purchase price has been paid in full.
CHAPTER VII: PRODUCT CHARACTERISTICS (MATERIAL & COLOURS)
(1) Color Deviations: MyyaTales endeavours to display and describe the products offered for sale as accurately as possible. Despite all care, the colours displayed on a screen may deviate from the original colours of the delivered goods due to technical reasons.
(2) Handmade & Natural Products: Since the finished unique pieces offered are handmade products, they may vary slightly in shape and colour. Furthermore, it lies in the nature of wool as a material that different production batches may lead to deviations in colour, texture, feel, lustre, surface, and appearance. Such material- and production-related deviations, as well as production-typical manufacturing knots, do not constitute a material defect within the meaning of warranty law, but are natural characteristics of the product.
(3) Workshop Material: The description of the respective workshop explicitly defines whether the required crocheting material (e.g., wool, needles) is included in the workshop price or must be purchased separately.
CHAPTER VIII: COPYRIGHT AND RIGHTS OF USE
(1) Protection of Content: The content of the materials provided in the workshop (e.g., instructions, scripts) as well as the products and designs offered for sale are protected by copyright. They are intended exclusively for the personal, non-commercial use of the Customer.
(2) Prohibitions of Use: Any further use, in particular the reproduction, distribution, translation, processing, and any form of commercial use, as well as disclosure to third parties (even in part or in a revised form), is prohibited without the prior written consent of MyyaTales.
(3) Recordings during Workshops: During the workshop, the creation of image, video, and audio recordings without prior consultation is prohibited. Photographing, filming, and sharing your own products created during the workshop for private purposes (e.g., on social media) is explicitly permitted and encouraged. The company is delighted by tags or links (e.g., @myyatales or #myyatales).
CHAPTER IX: WARRANTY, LIABILITY AND DAMAGES
(1) Warranty: The warranty for defects in delivered goods or services is provided in accordance with statutory regulations.
(2) General Limitation of Liability: MyyaTales is liable without limitation for damages resulting from injury to life, body, or health based on an intentional or negligent breach of duty by MyyaTales or its vicarious agents. For other damages (in particular property damage and financial losses), the Company is only liable in cases of intent or gross negligence. Liability for slight negligence regarding property damage and financial losses is excluded.
(3) Safety at Workshops & Personal Belongings: The workshop rooms as well as the provided tools and materials must be used with the necessary care. MyyaTales assumes no liability for the loss of or damage to brought personal items, clothing, or valuables of the participants, unless the damage was caused by the Company through gross negligence or intent.
(4) Liability of Participants & Duty of Supervision: Participants are liable for all damage to the premises, equipment, or provided tools and materials of MyyaTales caused by their fault. If parents or legal guardians accompany their children to the workshops, the legal duty of supervision remains with the parents or accompanying persons during the entire stay.
(5) Special Provisions for Children's Workshops: Children under eight (8) years of age may only participate in the workshop if actively accompanied by an adult and work together with this accompanying person. Tools (e.g., crochet needles, sewing needles, children's scissors) are used in the workshop. Participants and their accompanying persons will be instructed on the proper handling of these materials before the start of the workshop. Nevertheless, a manufacturing- and handling-typical residual risk for minor injuries (e.g., needle pricks) remains, for which Myyatales assumes no liability if the usual duties of care are observed.
(6) No Guaranteed Learning Success: MyyaTales provides its services within the scope of the workshops to the best of its knowledge and belief. A specific personal learning success or a concrete individual work result of the offered workshops and events is not owed by MyyaTales and cannot be guaranteed.
CHAPTER X: RIGHT OF WITHDRAWAL & CANCELLATION TERMS
(1) Digital Products: At contracts regarding the delivery of digital content not supplied on a tangible medium, the statutory right of withdrawal expires prematurely if MyyaTales has commenced performance of the contract (provision of the download/access). During the ordering process, the Customer is requested to give their explicit consent to the commencement of the performance of the contract before the expiry of the withdrawal period and to confirm their knowledge that they lose their right of withdrawal upon commencement of the performance of the contract. Without this consent, an order for digital products is technically not possible. Digital products are non-refundable after the performance of the contract has commenced.
(2) Physical Goods (Statutory Right of Withdrawal): Customers have the right to withdraw from the purchase contract within 14 days of receipt of the goods without giving reasons. To exercise the right of withdrawal, the Customer has to inform MyyaTales by means of an unequivocal statement (e.g. a letter sent by post or an email) of their decision to withdraw from this contract. The model withdrawal form provided on the website may be used for this purpose, but this is not mandatory. Returning the goods without comment does not constitute a legally effective withdrawal.
Exception: The right of withdrawal does not exist for contracts regarding goods made to customer specifications or clearly tailored to personal needs (personalised or custom-made products).
(3) Workshops:
- No Statutory Right of Withdrawal: In accordance with Section 18 Paragraph 1 No. 10 FAGG, there is no statutory right of withdrawal for services rendered in connection with leisure activities if a specific date or period is contractually provided for.
- Local Relocation: In the event of a subsequent change of the course location by MyyaTales, an extraordinary withdrawal by the Customer is only permissible if attending the new course location is not possible due to unreasonable travel times. All course locations within the Vienna city area that can be reached by public transport (Wiener Linien) are considered reasonable.
- Cancellation Terms for Participants: MyyaTales grants participants a contractual right of cancellation under the following conditions:

- Up to 30 days before the start of the workshop: Cancellation is completely free of charge; already paid fees will be refunded in full.
- From 30 days up to 14 days before the start of the workshop: A cancellation fee of 10% of the participation fee applies.
- From 14 days up to 3 days before the start of the workshop: A cancellation fee of 50% of the participation fee applies.
- Within 3 days before the start of the workshop or in case of non-attendance: A cancellation fee of 100% of the participation fee is due.
- Substitute Participant: The Customer is entitled to name a substitute participant at any time, who will enter into the contract in their place, provided they meet the participation prerequisites. In this case, the cancellation fees do not apply.
- A partial refund for only partial attendance at the workshop is excluded.

Cancellation by MyyaTales: In the event of illness of the instructor, failure to reach a specified minimum number of participants, or force majeure, MyyaTales has the right to cancel the workshop. Paid course fees will be refunded in full in this case or can be rebooked to an alternative date upon request. Further claims for compensation are excluded unless the cancellation is based on grossly negligent or intentional behaviour by MyyaTales.
CHAPTER XI: EXECUTION OF WITHDRAWAL & REFUNDS
(1) Condition of Goods upon Withdrawal: In the event of a timely and legally permissible withdrawal from the purchase contract, the refund of the purchase price takes place concurrently against the return of the goods received from the Customer. A prerequisite for a full refund of the purchase price is that the goods are returned to MyyaTales unused, undamaged, and in a condition that allows them to be resold as new. In the event of incomplete returns, signs of use, or damage, MyyaTales has the right to retain a reasonable compensation for loss of value.
(2) Return Period & Costs: The Customer must send back or hand over the goods to MyyaTales immediately and in any case no later than 14 days from the day on which MyyaTales was informed of the withdrawal from this contract. The deadline is met if the Customer dispatches the goods before the expiry of the 14-day period. The immediate costs of returning the goods shall be borne by the Customer.
(3) Refund: Following the receipt of the returned goods or after proof of return has been provided, MyyaTales shall initiate the reimbursement of the purchase price without undue delay and at the latest within 14 days. For this reimbursement, MyyaTales uses the same means of payment that the Customer used for the original transaction, unless explicitly agreed otherwise.
(4) Contact: To ensure quick and smooth processing, the Customer is politely requested to contact MyyaTales via email prior to returning the goods. However, the exercise of the statutory right of withdrawal is not dependent on this prior contact.
(5) Exclusion after Expiry of Deadline: After the expiry of the statutory 14-day withdrawal period, there is no contractual claim to an exchange or return of the goods due to dislike or incorrect ordering. Complaints regarding technically related colour deviations between the screen display and the original colours of the goods are excluded within the scope of statutory regulations (see Chapter VII Paragraph 1).
CHAPTER XII: RIGHT OF EXCLUSION FROM WORKSHOPS
MyyaTales has the right to exclude participants from the respective workshops if they do not meet the explicitly stated participation prerequisites (e.g. minimum age). A justified exclusion can also take place in the event of serious violations of group rules, improper or reckless behaviour, acute contagious diseases, intentional damage to property, or the endangerment of other participants. In the event of a justified exclusion, there is no claim to a refund of the course fee.
CHAPTER XIII: AMENDMENTS TO THE TERMS AND CONDITIONS (T&Cs)
For new orders and bookings, the current version of the T&Cs published on the website at the time of the conclusion of the contract shall apply. MyyaTales has the right to amend or adapt these T&Cs with effect for the future. In the event of material changes affecting existing continuous obligations or registered customer accounts, existing customers will be informed via email at least four weeks before the planned effective date. The changes shall be deemed approved by the Customer if they do not object in writing or via email within this four-week period. This will be separately pointed out in the amendment notice.
CHAPTER XIV: COMPANY DATA & LEGAL FORM
The company Mystical Yarnling Tales e.U. (Brand name: MyyaTales) is a registered sole proprietorship (eingetragenes Einzelunternehmen) under Austrian law with its corporate seat in Vienna.

CHAPTER XV: APPLICABLE LAW & PLACE OF JURISDICTION
(1) Applicable Law: All contracts and agreements between the Customer and MyyaTales shall be governed exclusively by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Note for Customers outside Austria: If you order as a private individual (consumer) and have your domicile in another country of the European Union (EU), the mandatory consumer protection laws of your home country remain unaffected by this regulation. In this case, the law more favourable to you shall apply.
(2) Place of Jurisdiction: For all disputes arising out of or in connection with these T&Cs, the following applies:
- If the Customer is a consumer within the meaning of the Austrian Consumer Protection Act (KSchG) and has their domicile, habitual residence, or place of employment in Austria, the court in whose district the consumer has their domicile, habitual residence, or place of employment shall have jurisdiction.
- For Customers who do not have a general place of jurisdiction in Austria or the EU, as well as for entrepreneurs (B2B), the court with material jurisdiction for Vienna is agreed upon as the exclusive place of jurisdiction.
